RULE 8. PROOF

Charges of misconduct or incapacity shall be established by clear and convincing evidence, and the burden of proof of the charges shall be on the disciplinary counsel. The burden of proof in proceedings seeking reinstatement following suspension or transfer to judicial incapacity inactive status is on the judge by clear and convincing evidence.
