12-4-2013 - Opinions

27334 - State v. Watkins

The Court reversed a Court of Appeals opinion that had reversed the trial judge's denial of the criminal defendant's motion that the judge recuse himself.

27335 - State v. Curry

In this direct appeal, the Court affirms Appellant's convictions and sentences for the offenses of voluntary manslaughter and possession of a weapon during the commission of a violent crime.

12-11-2013 - Opinions

27336 - State v. Hepburn

The Court reversed the circuit court's denial of Appellant's mid-trial motion for directed verdict, finding the waiver rule is operative in South Carolina, and exceptions exist to this rule where a co-defendant testifies implicating the criminal defendant and the defendant's testimony does not fill gaps in the State's case-in-chief. On the State's evidence alone, there was neither sufficient direct evidence nor substantial circumnstantial evidence to convict Appellant. Therefore, the Court directed a verdict of acquittal.

27337 - Jordan v. State

In this post-conviction relief case, the Court finds trial counsel had an actual conflict of interest and reverses and remands the matter for a new trial.

27338 - In the Matter Michael Anthony Walker

This is a disciplinary opinion in which the Court disbarred a lawyer.

27339 - In the Matter of Robert Lawrence Papa

This is a disciplinary opinion in which the Court definitely suspends a lawyer.

27340 - Carter v. Standard Fire Insurance

The Court affirms the court of appeals decision finding that Respondents were entitled to stack underinsured motorist coverage despite a policy exclusion purporting to limit stacking only to those vehicles owned by the insured and insured under the subject policy.

ORDER - In the Matter of Richard G. Wern
By order dated November 6, 2013, the Court placed respondent on interim suspension and appointed the Receiver, Gretchen B. Gleason, to protect the interests of his clients.
12-18-2013 - Opinions

27341 - Shatto v. McLeod Regional Medical Center

The Court reverses the court of appeals' finding that Petitioner was not an employee of McLeod Regional Medical Center and remands the matter to the court of appeals for a determination of whether Petitioner's injuries are compensable.
