6-3-2016 - Opinions

27640 - Maybank v. BB&T

This direct appeal from the Business Court arose from a substantial jury verdict involving claims sounding in contract, tort, and the South Carolina Unfair Trade Practices Act. The Court reverses the award of punitive damages based on a limitation of liability clause, and therefore declines to address election of remedies. The Court affirms the verdict on all other grounds, and rejects the plaintiff's cross-appeal regarding the trial court's denial of prejudgment interest.

6-8-2016 - Opinions

27641 - Simmons v. State

The Court vacates in part the PCR court's order and remands for further proceedings.

6-22-2016 - Opinions

27642 - In the Matter of James Cox, Jr.

This is an opinion in which the Court publicly reprimands a lawyer.

6-29-2016 - Opinions

27643 - In the Matter of William Franklin Warren, III

In this attorney discipline case, the Court disbars an attorney.

27644 - Van Sellner v. State

The Court reverses the PCR court's denial of Van Sellner's application for relief, finding Van Sellner's trial counsel was ineffective for advising him to take a plea deal when the State could not demonstrate all of the elements of armed robbery.
