Hubert Brown was convicted of first-degree burglary and attempted murder. After his convictions and sentences were affirmed on direct appeal, Brown applied for and was granted post-conviction relief ("PCR"). This Court granted the State's petition for a writ of certiorari to review the Court of Appeals' decision in Brown v. State, Op. No. 2020-UP-144 (S.C. Ct. App. filed August. 19, 2020), which affirmed the grant of PCR. The State contends the Court of Appeals erred in holding trial counsel was constitutionally ineffective in failing to object to a jury instruction and failing to object to the admission of evidence and testimony from expert witnesses.

The Court will determine whether a calendaring mistake constitutes good cause for purposes of reinstating an appeal and whether the Commission erred in failing to consider that appeal on the merits.
