In this worker's compensation case, Petitioner Shirley York and Respondent Yvonne Burns assert competing claims for death benefits. York is the decedent's mother and sought the benefits as the next of kin while Burns alleged she was the decedent's common-law wife. The commissioner found Burns was not common-law married and that although Burns was financially dependent on the decedent, South Carolina's fornication statute was dispositive. The commission affirmed, but the court of appeals reversed, holding there was no evidence of fornication and remanding for a determination of whether Burns was a "dependent" under sections 42-9-120 or 42-9-130. We granted certiorari.

In this driving under the influence case, the State appeals the circuit court's reversal of the magistrate court's conviction of Kathryn Martin Key. It contends the circuit court incorrectly found Key's blood alcohol level should have been suppressed. The State argues a warrant was not required for a blood sample, Key validly consented and did not revoke her consent, and exigent circumstances existed.
