January 15, 2003 Motion Fee Memo - Update to Memorandum Issued August 16, 2002

Effective July 1, 2002, Act No. 329 of 2002 amended the Code of Laws by adding � 8-21-320, which requires a fee of $25.00 to be collected for every motion made in the Court of Common Pleas and Family Court.

O R D E R


Pursuant to the provisions of S.C. Const. Art. V § 4,

Effective January 31, 2003, the attached Motion Information Form and Cover Sheet, SCCA/233 (1/2003) is approved for use in the Family and Circuit Courts of the State of South Carolina. This form replaces SCCA 233, which was approved for use by Administrative Order of the Chief Justice dated August 21, 1986. For the purposes of administration, the attached form shall be submitted with every motion or proposed order filed with the clerk of court or presented to a judge at chambers and shall remain as an attachment to the motion or proposed order, or copy of the same, as proof of payment, or in the alternative, as instruction for payment. The attached form shall also provide documentation for motion fee disputes in which a judge must make a determination on contested motion fees. Further, the attached form shall contain information necessary for the scheduling of motion hearings.
