Re: Affidavit of Indigency and Application for Counsel forms


ADMINISTRATIVE ORDER


Pursuant to the provisions of S.C. Const. Art. V § 4,

IT IS ORDERED that the revised Affidavit of Indigency and Application for Counsel forms bearing the revision date of (2/2009) are approved for use in the Circuit and Family Courts of South Carolina. SCACRVIFORM02GS should be used in Circuit Court for General Sessions cases. SCACRVIFORM02DR should be used in Family Court domestic relations cases, including child abuse and neglect proceedings. SCACRVIFORM02JU should be used in Family Court juvenile delinquency proceedings.

On page 1 of each form, a table has been inserted to include the applicant’s name, address, date of birth, social security number, and names of any co-defendants. On page 3 of each form, the second paragraph after number 8 has been revised to better adhere to the language of the applicable statute and budget proviso. At the end of the document, a section has been added for the judge or clerk to indicate whether the applicant’s application for court-appointed counsel is approved or denied.

These forms supersede all previous versions. The forms shall be used in accordance with Appendix A to Part VI of the South Carolina Appellate Court Rules and may be accessed on the S.C. Judicial Department website at http://www.sccourts.org/forms.
