18089   McGonigal's Flamingo, Inc., Plaintiff, v. RJG Construction Company, Formerly Known as R.J. Griffin & Company, Formerly known as Sebrell/Griffin & Company, Defendants._______________RJG Construction Company, Formerly known as R.J. Griffin & Company, Formerly known as Sebrell/Griffin & Company, Third-Party Plaintiff, v. Pegram Associates, Inc., Bonsal American, Inc., B&R Painting Contractors, Inc., Carnell Construction, Inc., Carolina Dee, Cayce Mechanical, Coastal Glass Company, Inc., Ely Wall & Ceilings Corporation, Tim Swanger Company, Spann Roofing and Sheet Metal, Inc., United Electric of Myrtle Beach, Inc., and Atlantic Coast Fire Protection, Third-Party Defendants.____________Coastal Glass Company, Inc., Third-Party Plaintiff, v. Acorn Window Systems, Inc., and YKK AP America, Inc., Third-Party Defendants of whom RJG Construction Company, Formerly Known as R.J. Griffin & Company, Formerly known as Sebrell/Griffin & Company is the Respondent, and Coastal Glass Company, Inc. is the Appellant.

J.J. Anderson, Eric M. Johnsen, Kathrine C. Miars, of Charleston, for Appellant. H. Brewton Hagood, James A. Bruorton, IV, and R. Britton Kelly, of Charleston, for Respondent.

In this construction defect case, Coastal Glass argues the trial court erred in (1) granting summary in favor of RJG Construction's contribution claim because genuine issues of material fact exist on whether Coastal's work contributed to the water intrusion damage at a hotel; (2) awarding RJG $211,700 on its contribution claim; and (3) awarding RJG $8,170.75 in pre-judgment interest.

 11:45 a.m. (Time Limits: 10 - 10 - 5)
18112   The State, Respondent, v. Lawrence Burgess, Appellant.

Appellate Defender Kathrine H. Hudgins, of South Carolina Commission on Indigent Defense, of Columbia, for Appellant. Attorney General Henry Dargan McMaster, Chief Deputy Attorney General John W. McIntosh, Assistant Deputy Attorney General Salley W. Elliott, Assistant Attorney General Deborah R. J. Shupe, of Office of the Attorney General, of Columbia, and Solicitor Donald V. Myers, of Lexington, for Respondent.

In this criminal case, Lawrence Burgess appeals his conviction for possession with intent to distribute crack cocaine arguing that the trial court erred in not dismissing his charge because the arresting officer lacked jurisdiction, allowing him to cross-examine the officer about his employment records, and charging mere presence to the jury.

Courtroom II
(Court convenes at 11:00 a.m.)
 11:00 a.m. (Time Limits: 10 - 10 - 5)
18111   The State, Respondent, v. Randolph Frazier, Appellant.

Appellate Defender M. Celia Robinson, of South Carolina Commission on Indigent Defense, of Columbia, for Appellant. Attorney General Henry Dargan McMaster, Chief Deputy Attorney General John W. McIntosh, Assistant Deputy Attorney General Salley W. Elliott, and Assistant Attorney General Mark R. Farthing, of Office of the Attorney General, of Columbia, and Solicitor Douglas A. Barfield, Jr, of Lancaster, for Respondent.

Randolph Frazier was convicted of first-degree burglary and sentenced to life in prison. On appeal, Frazier argues the trial court erred in (1) denying his motion to suppress, (2) allowing the victim and two neighbors to identify him in court, and (3) denying his motion for a mistrial based upon Rule 5, SCRCrimP, and Brady v. Maryland, 373 U.S. 83 (1963).

William Norman Epps, III, of Anderson, for Appellant. Druanne Dykes White, T. Harper Collins, and Sarah Ganss Drawdy, all of Anderson, for Respondent.

Wife appeals the order of the family court holding pasture land purchased by Husband prior to the marriage had not been transmuted into marital property and Wife did not have a special equity in the pasture land. Wife also argues the family court erred in failing to order the return to her of certain items of personal property.
