2018-000562 Mary P. Smith, Maezell Mitchell Jefferson, Individually and as personal representative of the Estate of Annabelle Thornton, Shirrese B. Brockington, as special administrator of the Estate of Janine Gourdine, Emma Smalls, Viola Pringle, Cephus Thornton, Arthur Graddick, III, an imprisoned person, Venetra Watson, and any known or unknown persons or entities claiming any interest in the Estates of Lucinda Pringle, Odessa Graddick, Arthur Graddick, Jr., Annabelle Thornton, and Janine Gourdine, Appellants,
v.
Angus M. Lawton, personal representative of the Estate of Lucinda Pringle, Evelina Brown Moses, Thomas P. Brown, Jr., and Unknown PR Rebecca Patricia Brown, Respondents. Thomas Jefferson Goodwyn, Jr., of Goodwyn Law Firm, LLC, of Columbia, for Appellants. Jonathan Scott Altman, of Derfner & Altman, LLC, of Charleston; and Stephen Michael Slotchiver of Slotchiver & Slotchiver, LLP, of Mount Pleasant, SC, for Respondents. In this probate action, the estates of Mary Smith, Annabelle Thornton, Emma Smalls, and Janine Gourdine (Appellants) appeals the circuit court's order affirming the probate court's order probating the will of Lucinda Pringle (decedent), which devised decedent's property to Evelina Moses, Thomas Brown, and Rebecca Brown (Respondents). On appeal Appellants argue the probate court erred in probating the will because (1) no evidence was offered to prove proper execution, (2) the will was altered, and (3) it was not offered timely. |

2018-000561 The State, Respondent,
v.
General T. Little, Appellant. Chief Appellate Defender Robert Michael Dudek and Vordman Carlisle Traywick, III, of Robinson Gray Stepp & Laffitte, LLC, both of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Michael Douglas Ross, both of Columbia, for Respondent. General T. Little appeals his conviction for murder of Barbra Little. On appeal, Little argues the trial court abused its discretion (1) failing to suppress evidence found in Little's vehicle and home following an illegal search, (2) denying his motion for a mistrial, and (3) admitting testimony from the State's footwear expert. |
|
11:20 a.m. | (Time Limits: 10-10-5-5) |
2018-000436 Deutsche Bank National Trust Company, as Trustee for NovaStar Mortgage Funding Trust, Series 2007-1 NovaStar Equity Loan Asset Backed Certificates, Series 2007-1, Respondent/Appellant,
v.
The Estate of Patricia Ann Owens Houck; Tammy M. Bailey; South Carolina Department of Motor Vehicles, Defendants,
Of which the Estate of Patricia Ann Owens Houck and Tammy M. Bailey are the Appellants/Respondents. Andrew Sims Radeker, of Harrison, Radeker & Smith, P.A., of Columbia, for Appellant-Respondents. Michael Casin Griffin, of Bradley Arant Boult Cummings, LLP, of Waxhaw, NC, for Respondent-Appellant. George Benjamin Milam and Jonathan Edward Schulz, both of Bradley Arant Boult Cummings, LLP, of Charlotte, NC, for Respondent-Appellant. Mary R. Powers, of Brock & Scott, PLLC, of Columbia, for Respondent-Appellant. In this cross-appeal, Patricia Owens and Tammy M. Bailey (collectively, Debtors), appeal the master-in-equity's order granting their motion for summary judgment and finding Deutsche Bank National Trust Company (Deutsche Bank) liable for failing to enter satisfaction of Debtors' mortgage pursuant to section 29-3-320 of the South Carolina Code (2007). Debtors solely argue the master erred by failing to require Deutsche Bank to pay the penalty required under section 29-3-320. Deutsche Bank argues the master erred by granting Debtors' motion for summary judgment and finding it was procedurally barred from seeking foreclosure of Debtors' mortgage. |

12:00 p.m. | (Time Limits: 10-10-5) |
2018-000448 The State, Respondent,
v.
Nick Russell Evangelista, Appellant. Chief Appellate Defender Robert Michael Dudek, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and William Joseph Maye, both of Columbia, for Respondent. Nick Evangelista appeals his murder conviction arguing the circuit court erred in (1) ruling inappropriate the expert testimony of Dr. Lois Veronen for the pretrial immunity hearing as to the battered person syndrome and Evangelista's state of mind, and (2) excluding evidence that Evangelista's live-in girlfriend, Rebecca Melton (Victim), operated a financial scam to return for a cash refund merchandise she never purchased, and that she had Evangelista take over or participate in the scam once she was discovered. |
