M. Rita Metts, of Metts Law Firm, of Columbia, for Appellant. Marion H. (Mark) Grier, Jr., of Lancaster, for Respondent.

In this appeal from the special referee's order, Kevin Waiters (Appellant) asserts the court erred by: 1) declaring deeds executed by certain heirs to be void, 2) finding there was no evidence of adverse possession, 3) failing to properly value the property at issue, 4) admitting certain evidence, 5) finding Appellant's family cut trees on the property, 6) failing to allow Appellants the opportunity to purchase the property, and (7) proceeding with the partition action once it became aware of missing heirs.

 10:40 a.m. (Time Limits: 10-10-5)
2015-001810    The State, Respondent, v. Marquez Devon Glenn, Appellant.

Roy F. Harmon, III, of Harmon & Major, PA, of Greenville, for Appellant. Christopher Todd Brumback, of Brumback & Langley, LLC, of Greenville, for Appellant. John Hampton Scully, of Greenville, for Appellant. Attorney General Alan McCrory Wilson and Senior Assistant Deputy Attorney General John Benjamin Aplin, both of Columbia, for Respondent. Solicitor William Walter Wilkins, III, of Greenville, for Respondent.

In this criminal appeal, Marquez Devon Glenn appeals his convictions of assault and battery of a high and aggravated nature (ABHAN) and possession of a weapon during the commission of a violent crime. Glenn asserts: (1) the circuit court abused its discretion in denying Glenn's motion for immunity pursuant to the Protection of Persons and Property Act (the Act) because Glenn was in a place where he had a right to be and was reasonably egressing the residence when he was attacked; (2) Spring Grove Apartment Complex's (Spring Grove) use of section 16-11-620 of the South Carolina Code (2015) in conjunction with its no trespass list violated the United States Housing Act's statutory mandate and the U.S. Housing and Urban Development (HUD)'s implementing regulations such that they constitute the grounds for the forfeiture of an individual's statutory right to self-defense; (3) the use of a general, non-specific allegation of loitering as a basis for a summary adjudication of a trespass violation on a public housing project property was unconstitutionally vague; and (4) the use of a three-year-old trespass notice as a bar to statutory immunity under the Act deprived Glenn of his right to due process of law.

Solicitor William Walter Wilkins, III, of Greenville, for Respondent.

Cynthia Greenfield appeals her conviction of trafficking methamphetamine. She contends the trial court erred in: (1) qualifying Detective Brooks as an expert; and (2) failing to grant her motion for a directed verdict.

2013-002752    The State, Respondent, v. Michael Levant Mealor, Appellant.

Attorney General Alan McCrory Wilson and Senior Assistant Deputy Attorney General Deborah R.J. Shupe, both of Columbia, for Respondent. Solicitor William Walter Wilkins, III, of Greenville, for Respondent.

Michael Mealor appeals his conviction of trafficking methamphetamine. He contends the trial court erred in permitting the introduction of logs from a national database of pseudoephedrine sales. Additionally, he maintains the trial court erred in denying his motion for a directed verdict.

Attorney General Alan McCrory Wilson, Senior Assistant Deputy Attorney General John Benjamin Aplin, and Assistant Attorney General Jonathan Scott Matthews, all of Columbia, for Respondent. Solicitor Ernest Adolphus Finney, III, of Sumter, for Respondent.

In this criminal appeal, Jeffrey Dana Andrews appeals his convictions of voluntary manslaughter and possession of a weapon during the commission of a violent crime. On appeal, Andrews argues the circuit court erred in (1) abdicating its duty as fact finder by denying Andrews immunity under the Protection of Persons and Property Act because witness testimony was inconsistent; (2) refusing to qualify Investigator Terry Gainey as an expert in interrogation and force science when Gainey was qualified by experience and training; and (3) admitting the testimony of Kimberly Graham, an EMS paramedic, when Graham was not an expert in crime scene investigation and her opinion was highly prejudicial.

Courtroom I
 10:00 a.m. (Time Limits: 10-10-5)
2015-002199    Faye P. Croft, Personally and as Trustee of the James A. Croft Trust; James A. Croft Trust; William A. Harbeson; Heyward G. Hutson; James Stephen Greene, Jr.; South Carolina Public Interest Foundation; Summerville Preservation Society; and Dorchester County Taxpayers Association, individually, and on behalf of all others similarly situated, Appellants, v. Town of Summerville and Town of Summerville Board of Architectural Review, Respondents.

Michael T. Rose of Mike Rose Law Firm, PC, of Summerville, SC for Appellants. W. Andrew Gowder, Jr. of Austen & Gowder, LLC, of Charleston, for Appellants. G. Waring Parker of G. Waring Parker Law Firm, LLC, of Summerville, for Respondents. Timothy Alan Domin of Clawson & Staubes, LLC, of Charleston, for Respondents.

On appeal, Appellants argue the circuit court erred in affirming two decisions of the Town of Summerville Board of Architectural Review (the Board) by (1) requesting and considering evidence created after Appellants appealed the Board's decisions, (2) failing to remand the case due to an insufficient record, and (3) approving the Board's decisions when it failed to adopt, develop, and comply with rules of procedure. Appellants also argue the Board's decisions were without factual support, the Board held meetings that violated the South Carolina Freedom of Information Act, and the Board erroneously issued a certificate of appropriateness based upon unqualified applications and without considering public objections.

 10:40 a.m. (Time Limits: 10-10-5)
2015-000281    The State, Respondent, v. Trevin Millidge, Appellant.

Timothy J Vitollo of Vitollo Law Firm, LLC, of North Charleston, for Appellant. Chief Appellate Defender Robert Michael Dudek, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Assistant Attorney General Mark Reynolds Farthing, both of Columbia, for Respondent. Solicitor Isaac McDuffie Stone, III, of Bluffton, for Respondent.

Trevin Millidge appeals his convictions and sentences for trafficking in crack cocaine, possession with intent to distribute cocaine, possession of a Schedule IV controlled substance, and possession of a Schedule II controlled substance. Millidege contends the trial court erred in (1) denying his motion to suppress evidence obtained by a search warrant which contained insufficient information concerning a confidential informant's reliability and (2) denying his motion to suppress his alleged confession because (a) it was obtained from a defective search warrant and was, therefore, fruit of the poisonous tree and (b) he was not advised of his right to remain silent and his right to an attorney.

 11:20 a.m. (Time Limits: 10-10-5)
2015-000516    The State, Respondent, v. Archie More Hardin, Appellant.

Daniel Carson Boles, of Charleston, for Appellant. Chief Appellate Defender Robert Michael Dudek, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Senior Assistant Attorney General John Benjamin Aplin, both of Columbia, for Respondent. Solicitor David Michael Pascoe, Jr., of Orangeburg, for Respondent.

Archie More Hardin appeals his convictions for three counts of kidnapping, one count of armed robbery, one count of assault and battery of a high and aggravated nature, and one count of possession of a weapon during a violent crime, arguing the trial court erred in (1) denying his motion for a continuance, (2) concluding that while the procedure used by law enforcement was unduly suggestive, the out-of-court identification made by the three victims was nevertheless so reliable that no substantial likelihood of misidentification existed, and (3) admitting evidence collected in the second warrantless search of his apartment.

Tuesday, February 6, 2018
Courtroom II
 10:00 a.m. (Time Limits: 10-10-5)
2015-002054    In re: Tony Megna, Respondent, James A. Anasti, Appellant, v. Lance Wilson, Willis Goodwin, Gina L. Anasti Lee, and Richland County Clerk of Court, Defendants.

Douglas Neal Truslow, of Truslow & Truslow, of Columbia, for Appellant. Keith M. Babcock and Ariail Elizabeth King, both of Lewis Babcock L.L.P., of Columbia, for Respondent. James Mixon Griffin, of Griffin - Davis, of Columbia, for Respondent.

Appellant James A. Anasti filed this appeal challenging a circuit court order that denied his Rule 11, SCRCP motion for sanctions against Respondent Tony Megna who represented defendant Gina Lee in the underlying action. Anasti claims the circuit court erred by finding (1) there was no controlling case law addressing Megna's asserted defenses and (2) Anasti failed to produce sufficient evidence of the mental state required for sanctions under Rule 11.

 10:40 a.m. (Time Limits: 10-10-5)
2015-001053    Marjorie Cato Burton as Trustee of the Sloan Marvin Burton and Marjorie Cato Burton, AB Living Trust by and through David A. Burton as Attorney-in-Fact, Individually and in the right and on behalf of T.E. Cato Estate, LLC, Appellant, v. Carroll M. Pitts, Jr., Esq. and Robinson Bradshaw & Hinson, P.A., Respondents.

Matthew B. Rosbrugh, of MBR Law, LLC, of Columbia, for Appellants. C. Mitchell Brown, Allen Mattison Bogan, and Blake Terence Williams, all of Nelson Mullins Riley & Scarborough, LLP, of Columbia, for Respondents. Samuel W. Outten of Nelson Mullins Riley & Scarborough, LLP of Greenville, for Respondents.

In this legal malpractice, non-jury action, Appellants (the Trust and the LLC) appeal the trial court's order, arguing the court erred in finding the following: (1) Respondents committed professional negligence, but there were no proximately caused damages; (2) there was no attorney-client relationship between Respondents and the Trust; (3) the statute of limitations barred the LLC's claims; and (4) dissolution of the LLC prevented recovery of claims assigned to an LLC member. Appellants also argue the trial court abused its discretion in denying a motion to amend the complaint.

 11:20 a.m. (Time Limits: 10-10-5)
2015-001845    John M. McIntyre and Silver Oak Land Management, LLC, Appellants, v. Securities Commissioner of South Carolina, Respondent.

Robert V. Mathison, Jr. of Mathison & Mathison, of Hilton Head Island, for Appellants. Cory E. Manning of Nelson Mullins Riley & Scarborough, LLP, of Columbia, for Appellants. Marilyn Elaine Ligon Gartley, of Anderson & Assoc., PA, of Columbia, for Respondent. Deputy Securities Commissioner Tracy A. Meyers, of Columbia, for Respondent. Attorney General Alan McCrory Wilson and Assistant Attorney General Ian P. Weschler, both of Columbia, for Respondent.

John McIntyre and Silver Oak Land Management (SOLM) (collectively "Appellants") appeal the circuit court's order affirming the final order of the Securities Commissioner (Commissioner), which found Appellants committed fifty-four violations of the anti-fraud provision of the South Carolina Uniform Securities Act (Act). On appeal, Appellants argue the circuit court (1) failed to properly review the factual findings of the Commissioner under section 35-1-609 of the South Carolina Code (Supp. 2017); (2) erred in finding the LLC interests qualified as securities; (3) erred in finding the alleged fraudulent conduct occurred in connection with the offer, sale, or purchase of the LLC interests; (4) erred in finding Appellants' procedural due process rights were not violated; and (5) erred in finding substantial evidence existed in the record to support the factual findings of the Commissioner.
