In this probate matter, Charles Gordon, as personal representative for the estate of Clara Burch, appeals the circuit court's failure to grant a directed verdict in his favor as to certain claims, related to the transfer of Clara's assets, against Laurie and Dennis Burch, children of Clara's husband George Burch, and Jacqueline Busbee, individually and as personal representative of George's estate. Gordon further appeals the failure of the circuit court to give certain jury instructions and the circuit court's denial of his post-trial motions.

In this criminal appeal from York County, the appellant argues the trial court erred in failing to suppress drug evidence discovered in the trunk of his rented car during a traffic stop on I-77. On appeal, the appellant argues the police officers illegally extended his detention and lacked probable cause for the search that discovered the drugs.

Stonington owned part of a subdivision adjoining Hollis's land. Hollis alleged that Stonington's failure to provide stormwater control damaged his two ponds. He filed a complaint against Stonington asserting negligence, trespass, private nuisance, and a violation of the Unfair Trade Practices Act. The jury returned a verdict for Hollis that included punitive damages. Stonington appeals alleging the trial court erred in (1) denying its motion for a directed verdict on punitive damages, (2) instructing the jury that there were actual and punitive damages, (3) entering the jury room, and (4) denying its motion for judgment notwithstanding the verdict, new trial absolute, and new trial nisi remittitur. It also appeals the jury award of punitive damages almost nine times the actual damages.

Port City appeals the circuit court's ruling that its claim for "common expenses" due under a lease with the City of Charleston was barred in part by the statute of limitations and that under the parties' prior course of dealing, no additional monies were owed to Port City under the lease.

This case concerns the enforcement of a restrictive covenant prohibiting a grantee from selling alcoholic beverages on the property. SGM is the fourth grantee of property and Smith is the original grantor. SGM operates a truck stop on the property and began selling alcohol. Smith filed a complaint seeking to enforce the restrictive covenant. The circuit court issued an order enjoining SGM from selling alcohol from which SGM now appeals

Robert Siefer was convicted of criminal sexual conduct with a minor second degree. On appeal, Siefer contends the trial court erred in admitting alleged prior instances of sexual abuse under Rule 404(b), SCRE and erred in denying his request to recharge the jury on reasonable doubt when the court recharged the jury S.C. Code Section 16-3-657 in response to a question from the jury.

In this medical malpractice action, the Smiths appeal the circuit court's grant of summary judgment in favor of the hospital because the physician-defendant was not an employee of the hospital but an independent contractor. They maintain the immunity of the Tort Claims Act does not apply to this case because the hospital owed a non-delegable duty to its emergency room patients as discussed in Simmons v. Tuomey Medical Center, 341 S.C. 32, 533 S.E.2d 312 (2000).

On appeal, the State contends the trial court erred in suppressing the videotape, evidence, and breath tests results produced at the breath test site following Philip Sawyer's arrest for driving under the influence. Despite the State's failure to record the audio portion of Sawyer's breath test, the State claims the videotape and ensuing evidence were admissible based on the totality of circumstances.

In this criminal case, Robert Taylor appeals his convictions for criminal sexual conduct with a minor in the second degree and kidnapping, arguing the trial court erred in (1) granting the State’s Batson motion, (2) admitting evidence of a Taylor’s prior conviction for criminal sexual conduct with a minor in the second degree, (3) finding the probative value of Taylor’s prior conviction substantially outweighed its prejudicial value, (4) denying Taylor’s motion for a directed verdict, and (5) sentencing Taylor to life without parole.

Spears argues the trial court erred in: (1) denying his motion to sever his case from the co-defendant's case prior to trial; (2) denying his motion to suppress evidence that Spears submits was obtained without a valid search warrant and without valid consent; (3) denying his motion to suppress trial testimony and evidence of a gun found in the room where Spears was taken into custody; (4) denying his motion to suppress trial testimony identifying both defendants; and (5) denying his motion for a mistrial, which was made on multiple grounds.
