McIntosh, Assistant Deputy Attorney General Donald J. Zelenka, and Assistant Attorney General Derrick McFarland, of Columbia, and Solicitor Robert M. Ariail, of Greenville, for Respondent.

In this murder case, appellant contends the trial court committed reversible error by refusing to sever the murder charge from the trafficking in cocaine charge since there was not any legitimate or close nexus between the large amount of cocaine discovered in appellant's trunk during a traffic stop almost seven weeks after the murder, and the murder itself, and the undue prejudice of evidence of trafficking in cocaine warranted a severance.

McIntosh, Assistant Deputy Attorney General Donald J. Zelenka, and Assistant Attorney General S. Creighton Waters, of Columbia, and Solicitor Randolph Murdaugh, III, of Hampton, for Respondent.

In this murder case, appellant alleges the trial court committed reversible error by refusing: (1) to charge the jury with self-defense where there was evidence in the record to establish the defense; and (2) to allow the testimony of appellant's expert witness where the evidence was relevant to appellant's mental state, both at the time he made a statement to police and at the time of the shooting.

Keith appeals his conviction for kidnapping, arguing that (1) there was no direct evidence or substantial circumstantial evidence that he did anything or that he kidnapped the complaining witness as envisioned by the kidnapping statute, and (2) the trial court erred by admitting testimony of two witnesses because the evidence was not admissible under either State v. Lyle or Rule 404(b), SCRE, since it was not sufficiently similar to the present case to constitute a common scheme or plan, or lack of accident or mistake, or to prove intent to kidnap.
