In this civil action, Appellant contends that the Master in Equity erred by (1) not granting Plaintiff's motion to set aside the sale based on the test in Poole v. Jefferson Standard Life Ins. Co., 174 S.C. 150, 177 S.E. 24 (1934), as applied in Spillers v. Clay, 233 S.C. 99, 103 S.E.2d 759 (1958); and (2) finding the final bid was not so inadequate so as to shock the conscience of the court.

Jay T. Gouldon and R. Spencer Roddey, of Charleston, for Appellant. Robert Bates Lovett and Kirby Mason, of Savannah, Georgia, for Respondent.

In this action for unpaid rent against Bradley Coker (Son) and Dale Coker (Father), the circuit court granted summary judgment against Son, finding an amended lease did not release Son from the obligations under the lease. Son appeals, arguing: (1) the court erred in granting HK's motion for summary judgment because it was clear from the language of the amendment to the lease that the parties intended for Son to be released from liability; (2) the court erred in granting HK's motion for summary judgment because there is an ambiguity in the contract which, when resolved by consideration of extrinsic evidence, shows HK agreed to release Son from the lease; and (3) the court erred in granting summary judgment because the ambiguity in the amendment to the lease or in inferences derived therefrom created questions of fact to be decided by the jury.

Instead of appointing Daughter to be conservator over her Mother, the probate court appointed a neutral third party to be conservator over Mother, and the circuit court affirmed. Daughter appeals, arguing the probate court erred in failing to name her as conservator because it did not make a finding of just cause to do otherwise.
