Clifford, of Columbia, and Assistant Deputy Attorney General Salley W. Elliott, of Columbia, for Respondent. In this criminal case, the Appellant posits three issues for review on appeal: (1) the denial of Appellant's request for a jury instruction on a good faith defense to forgery; (2) the denial of Appellant's request to instruct the jury on its use of evidence of Appellant's good character; and (3) the denial of Appellant's motion for directed verdict.

14181 The State, Respondent, v. Timothy Terreal Kinard, Appellant. Appellate Defender Kathrine H. Hudgins, of South Carolina Commission on Indigent Defense, of Columbia, for Appellant. 15040 Ex Parte: Eastern Savings Bank, FSB, Appellant, v. Albert J. Sanders, Jr., Respondent,___________________In Re: Eastern Savings Bank, FSB, Plaintiff, v. Roy A. Rouse, a/k/a Roy Rouse, Jean C. Rouse, a/k/a Jean Rouse, Neff Rental, Inc., and Oswald Wholesale Lumber, Inc., Defendants. Thomas A. Shook, of North Charleston, for Appellant. James W. Poag, Jr., of West Columbia, for Respondent. In this civil action, Appellant contends that the Master in Equity erred by (1) not granting Plaintiff's motion to set aside the sale based on the test in Poole v. Jefferson Standard Life Ins. Co., 174 S.C. 150, 177 S.E. 24 (1934), as applied in Spillers v. Clay, 233 S.C. 99, 103 S.E.2d 759 (1958); and (2) finding the final bid was not so inadequate so as to shock the conscience of the court.
|
|
2:00 p.m. | (Time Limits: 10 - 10 - 5 ) |
15096 HK New Plan Exchange Property Owner I, LLC, Respondent, v. Dale A. Coker and Bradley Coker, d/b/a Japan Karate Institute, Defendants, of whom Bradley A. Coker is the Appellant. Jay T. Gouldon and R. Spencer Roddey, of Charleston, for Appellant. Robert Bates Lovett and Kirby Mason, of Savannah, Georgia, for Respondent. In this action for unpaid rent against Bradley Coker (Son) and Dale Coker (Father), the circuit court granted summary judgment against Son, finding an amended lease did not release Son from the obligations under the lease. Son appeals, arguing: (1) the court erred in granting HK's motion for summary judgment because it was clear from the language of the amendment to the lease that the parties intended for Son to be released from liability; (2) the court erred in granting HK's motion for summary judgment because there is an ambiguity in the contract which, when resolved by consideration of extrinsic evidence, shows HK agreed to release Son from the lease; and (3) the court erred in granting summary judgment because the ambiguity in the amendment to the lease or in inferences derived therefrom created questions of fact to be decided by the jury.

Instead of appointing Daughter to be conservator over her Mother, the probate court appointed a neutral third party to be conservator over Mother, and the circuit court affirmed.
