Appellant, Stephen Atherton, on behalf of himself and all others similarly situated, filed a complaint asserting four causes of action against respondents, Tenet Healthcare Corp. and AMISUB of South Carolina Inc., alleging overcharges by respondents' hospital in derogation of a contractual agreement between York County and respondents. The trial court granted summary judgment for respondents on all causes of action. Atherton appeals arguing the trial court erred in: (1) concluding the requested relief in all of appellant's causes of action would require the trial court to engage in judicial rate-making and thus such claims violated the separation of powers doctrine under the South Carolina Constition; (2) concluding that the agreement between the respondents and York County clearly and unambiguously excluded third party beneficiaries thereby barring appellant's breach of third party beneficiary contract claim; (3) concluding that appellant cannot maintain a cause of action for unjust enrichment; (4) concluding appellant's claim for breach of an implied contract for value fails to state a viable cause of action; and (5) ruling that appellant is not entitled to injunctive relief.

Appellant appeals his conviction for possession of crack cocaine, arguing the trial judge erred in refusing to suppress the evidence of the crack cocaine on the ground it was the fruit of an illegal warrantless search.

Following a jury verdict for actual and punitive damages in favor of respondent, the appellant appeals, arguing the trial judge erred in: (1) failing to direct a verdict in favor of appellant on all causes of action; (2) failing to direct a verdict in favor of appellant as to damages; (3) allowing respondent to amend his complaint during the trial; and (4) failing to grant appellant's motion for a continuance after he permitted respondent to amend his complaint.

In this civil action, appellants contend the trial court abused its discretion in finding Laurens W. Floyd, Jr. in contempt of its orders and requiring him to pay sanctions including legal expenses of the respondent. Further, appellants aver the trial court erred in admitting certain letters into evidence in violation of the hearsay rule and the attorney-client privilege. Finally, appellants allege that the trial court erred in removing Laurens W. Floyd, Jr., as trustee of the charitable remainder trust.

In this appeal from an insurance case, the court analyzes the terms of a life insurance application and ensuing policy to determine if the insured had the right to change the beneficiary during her lifetime.

In this Workers' Compensation case, claimant was denied compensation by the single commissioner and the appellate panel for an alleged carpal tunnel syndrome injury. The basis for the denial of compensation was the failure of the claimant to report an alleged injury in January 2001 until December 2001. The Workers' Compensation Appellate Panel ruled that the claimant did not provide a reasonable excuse for her failure to give notice and the employer was prejudiced thereby. The circuit court reversed, concluding that the order of the appellate panel was not supported by substantial evidence in the record.
