13408 Stephen Atherton, on behalf of himself and all others similarly situated, Appellant v. Tenet Healthcare Corporation and AMISUB of South Carolina, Inc., Respondents. Chad McGowan and Kevin Sitnik, of Rock Hill, and Stephen Atherton, Gordon Ball, and Chris Cain, of Knoxville, TN, for Appellant. Daniel J. Westbrook and Alice V. Harris, of Columbia, for Respondents. Appellant, Stephen Atherton, on behalf of himself and all others similarly situated, filed a complaint asserting four causes of action against respondents, Tenet Healthcare Corp. and AMISUB of South Carolina Inc., alleging overcharges by respondents' hospital in derogation of a contractual agreement between York County and respondents. The trial court granted summary judgment for respondents on all causes of action. Atherton appeals arguing the trial court erred in: (1) concluding the requested relief in all of appellant's causes of action would require the trial court to engage in judicial rate-making and thus such claims violated the separation of powers doctrine under the South Carolina Constition; (2) concluding that the agreement between the respondents and York County clearly and unambiguously excluded third party beneficiaries thereby barring appellant's breach of third party beneficiary contract claim; (3) concluding that appellant cannot maintain a cause of action for unjust enrichment; (4) concluding appellant's claim for breach of an implied contract for value fails to state a viable cause of action; and (5) ruling that appellant is not entitled to injunctive relief.

Baker, all of Charleston, for Appellant. S. Thomas Worley, Jr., of Mt. Pleasant, and Douglas H. Westbrook, of Charleston, for Respondent. Edward Bennett, as personal representative of the estate of Isaiah Bennett, appeals from the order of the master in equity, in which the master held; (1) Isaiah Bennett had gifted property to Vanderhorst; (2) Isaiah Bennett had not adversely possessed the property; and (3) there was no resulting trust on the property.

Stumbo, of Columbia, and Solicitor Barbara R. Morgan, of Aiken, for Respondent. Appellant appeals his conviction for possession of crack cocaine, arguing the trial judge erred in refusing to suppress the evidence of the crack cocaine on the ground it was the fruit of an illegal warrantless search.

13333 Marshall Armstrong, Respondent v. Fred Collins, Jr., Appellant. Melvin Hutson and Lynn R. Hudson, of Greenville, and Charles E. Carpenter, Jr., and S. Elizabeth Brosnan, of Columbia, for Appellant. Richard A. Harpootlian and James Richardson, of Columbia, and Richard J. Breibart, of Lexington, for Respondent. Following a jury verdict for actual and punitive damages in favor of respondent, the appellant appeals, arguing the trial judge erred in: (1) failing to direct a verdict in favor of appellant on all causes of action; (2) failing to direct a verdict in favor of appellant as to damages; (3) allowing respondent to amend his complaint during the trial; and (4) failing to grant appellant's motion for a continuance after he permitted respondent to amend his complaint.

13309 Anne H. Floyd, Respondent v. Laurens W. Floyd, Jr., individually and as Trustee of the Laurens Floyd Trust and the Charitable Remainder Trust of Laurens W. Floyd and Anne H. Floyd; Daniel D. Floyd; Daniel Bozard as co-trustee of the Laurens Floyd Trust and the Charitable Remainder Trust of Laurens W. Floyd are the Appellants. M. M. Weinberg, Jr., of Sumter, for Appellants. Clarke W. DuBose, of Columbia, for Respondent. In this civil action, appellants contend the trial court abused its discretion in finding Laurens W. Floyd, Jr. in contempt of its orders and requiring him to pay sanctions including legal expenses of the respondent. Further, appellants aver the trial court erred in admitting certain letters into evidence in violation of the hearsay rule and the attorney-client privilege. Finally, appellants allege that the trial court erred in removing Laurens W. Floyd, Jr., as trustee of the charitable remainder trust.
