Court of Appeals - Roster of Cases for Hearing

The summary below each case is prepared to offer lawyers and the public a general overview of what issues are included in a case which will be argued. The summary is not a limit on what issues a party to a case may present at oral argument.
Monday, May 7, 2007
Courtroom I
(Court convenes at 2:00 p.m.)
 2:00 p.m. (Time Limits: 10 - 10 - 5 )
15133   Frank M. Marvin, Respondent, v. Frances R. Pritchett, Appellant.

Ellis Reed-Hill Lesemann, of Charleston, for Appellant. G. Thomas Hill, of Ravenel, and Joseph Kevin Qualey, of Charleston, for Respondent.

In this partition action, Francis Pritchett appeals the master's order denying the Commissioner's recommendation for partition and ordering partition by sale. Pritchett argues the master's order should be reversed because the Commissioner's report was not clearly "erroneous, unfair, unjust, and inequitable," and the property at issue is capable of being partitioned in kind.

 2:45 p.m. (Time Limits: 10 - 10 - 5 )
15126   The State, Respondent, v. John Henry Ward, Appellant.

Chief Attorney Joseph L. Savitz, III, of South Carolina Commission on Indigent Defense, of Columbia, and William J. Watkins, Jr. of Greenville, for Appellant. Attorney General Henry Dargan McMaster, Chief Deputy Attorney General John W. McIntosh, Assistant Deputy Attorney General Donald J. Zelenka, and Assistant Attorney General Melody Brown, of Office of the Attorney General, of Columbia, and Solicitor Ralph E. Hoisington, of Charleston, for Respondent.

Ward appeals from his conviction for murder, arguing the trial court erred in (1) refusing to grant a mistrial after the State insinuated the crime was gang-related; (2) permitting autopsy photos of the victim into evidence; (3) charging the jury that "the hand of one is the hand of all:" (4) failing to direct a verdict in his favor; and (5) permitting the State to play a recording of a co-defendants testimony given in a previous trial.

 3:30 p.m. (Time Limits: 10 - 10 - 5 )
15149   Peter C. Plott, and Demitria C. Votta, Respondents, v. Justin Enterprises, a South Carolina General Partnership, Russ Pye and Lee Pye, Appellants.

Eugene P. Corrigan, III, of Charleston, and Michael A. Timbes, of Charleston, for Appellants. Marvin I. Oberman and Harold A. Oberman, of Charleston, for Respondents.

In this declaratory judgment action, the defendants appeal the trial judge's finding that they have infringed on the plaintiffs' right of use of an easement. Specifically, the defendants contend on appeal (1) the plaintiffs' claim was barred by res judicata or collateral estoppel; (2) the trial judge incorrectly interpreted the scope of the easement; and (3) the original grant of the easement was invalid.

Jonathan Brent Kiker, of Hilton Head Island; James B. Richardson, Jr., of Columbia; and Keating L. Simons, III, of Charleston, for Appellant. Drew A. Laughlin, of Hilton Head Island, for Respondent.

In this consolidated appeal, CSB appeals the circuit court's order holding that its property was bound by a restrictive covenant that ran with the land. CSB further appeals the determination that the heirs of the grantor who restricted the property could not cancel the restriction.

15141   HHI Corporation, Limited, Respondent, v. CSB Development Co., Inc., Appellant.

Attorney General Henry Dargan McMaster, Deputy Attorney General T. Stephen Lynch, and Assistant Deputy Attorney General J. Emory Smith, Jr., of Office of the Attorney General, of Columbia, for Respondent State of South Carolina.

In this property case, the appellant appeals the Master’s placing of the boundary line, finding respondent had obtained title to certain subject property by adverse possession, finding the boundary line was established as a matter of acquiesce and Res Judicata, denying appellant’s motion for a new trial based on newly discovered evidence, and dismissing appellant’s claim for trespass against respondent.

 3:30 p.m. (Time Limits: 10 - 10 - 5 )
15134   Shirley Leder Osterneck, as Personal Representative of the Estate of Guy Kenneth Osterneck, Appellant, v. Myles N. Osterneck, Gertrude B. Osterneck, and Rhoda Osterneck, Respondents.
