Jeffrey E. Morton was indicted for attempted murder and subsequently convicted of the lesser-included offense of assault and battery of a high and aggravated nature. He appeals, arguing the trial court erred in admitting testimony of prior bad acts because the prior bad act was not established by clear and convincing evidence and the probative value was substantially outweighed by its danger of unfair prejudice. Morton further argues the trial court erred in denying his motion for a directed verdict on the attempted murder charge because there was no evidence of malice.
