In this civil action, American Medical Response, Inc. (AMR) appeals the circuit court's grant of summary judgment in favor of Charles Gary on his negligence and loss of consortium claims. AMR argues the circuit court erred in (1) concluding the contract between the South Carolina Department of Health and Human Services and AMR imposed upon it a duty to provide "safe" transportation that gave rise to tort claims; (2) holding AMR could not escape liability for the negligent actions of a subcontractor because it owed Gary an absolute, nondelegable duty to provide safe transportation; and (3) granting summary judgment in favor of Gary when the parties had not yet completed material discovery and genuine issues of material fact existed.
