2012-213596    The State, Respondent, v. Cleophus N. Edwards, Jr., Appellant.

Chief Appellate Defender Robert Michael Dudek and Arthur Kerr Aiken of Aiken & Hightower, both of Columbia, for Appellant. Attorney General Alan McCrory Wilson, Chief Deputy Attorney General John W. McIntosh, Senior Assistant Deputy Attorney General Donald J. Zelenka, and Assistant Attorney General Caroline M. Scrantom, all of Columbia, and Solicitor David Michael Pascoe, Jr., of Orangeburg, for Respondent.

Cleophus N. Edwards, Jr. appeals his convictions for murder, first-degree burglary, and possession of a weapon during the commission of a violent crime. Edwards argues the trial court erred in admitting into evidence (1) a laptop computer, (2) clothing and shoes, and (3) the results of a DNA analysis and a shoe imprint comparison.

 10:40 a.m. (Time Limits: 10-10-5)
2014-000461    Michael Heath Bolin, #341806, Appellant, v. South Carolina Department of Corrections, Respondent.

Trent Neuell Pruett of Pruett Law Firm, of Gaffney, for Appellant. Daniel John Crooks, III, of Columbia, for Respondent.

Appellant Michael Bolin challenges a decision of the South Carolina Administrative Law Court upholding a determination of the South Carolina Department of Corrections that Bolin must serve eighty-five percent of his sentence before he is eligible for early release, discharge, or community supervision. Bolin argues that the eighty-five percent requirement of section 24-13-150 of the South Carolina Code does not apply to any of the offenses to which he pled guilty because none of them are considered "no parole offenses."

 11:20 a.m. (Time Limits: 10-10-5)
2012-211091    Darryl Frierson, Petitioner, v. State of South Carolina, Respondent.

Appellate Defender Kathrine Haggard Hudgins, of Columbia, for Petitioner. Attorney General Alan McCrory Wilson, Assistant Attorney General John Walter Whitmire, and Assistant Attorney General James Clayton Mitchell, III, all of Columbia, for Respondent.

In this appeal from the denial of an application for post-conviction relief (PCR), Darryl Frierson argues the PCR court erred because his guilty plea was involuntary due to counsel's failure to advise him he could challenge the placement of a tracking device on his car pursuant to section 17-30-140 of the South Carolina Code and could move to suppress the evidence gained as a result of the search.

 12:00 p.m. (Time Limits: 10-10-5)
2012-206008    Frankie Lee Bryant III, Respondent, v. State of South Carolina, Petitioner.

Attorney General Alan McCrory Wilson, Chief Deputy Attorney General John W. McIntosh, Senior Assistant Deputy Attorney General Salley W. Elliott, Assistant Deputy Attorney General David A. Spencer, and Assistant Attorney General Christina Catoe Bigelow, all of Columbia, for Petitioner. Chief Appellate Defender Robert Michael Dudek and Appellate Defender Lara Mary Caudy, both of Columbia, for Respondent.

The State appeals from the post-conviction relief (PCR) court's ruling that Frankie Bryant's trial counsel was ineffective. The State argues the PCR court erred in finding counsel was ineffective for failing to object to the jury instruction on self-defense because the instructions substantially charged the correct law and were not prejudicial.

Zelenka, and Senior Assistant Attorney General Melody Jane Brown, all of Columbia, for Respondent. Solicitor Daniel Edward Johnson, of Columbia, for Respondent.

Marcus Bailey appeals from his murder conviction asserting the trial court erred in (1) admitting testimony from a cadaver dog handler, (2) denying his motion for directed verdict, (3) admitting the testimony of a witness without permitting full cross-examination on the witness' pending criminal charges, (4) admitting character evidence of him, (5) refusing to suppress or strike evidence gathered pursuant to a search warrant because the attesting officer had no personal knowledge, and (6) admitting his statement in violation of sections 19-1-90 and 8-15-50 of the South Carolina Code.

 10:40 a.m. (Time Limits: 10-10-5)

In this criminal matter, Jovan Alexander Mitchell appeals his conviction for grand larceny in an amount between $1,000 and $5,000, arguing the circuit court erred in (1) denying his directed verdict motion when the evidence showed the victim did not own the metal that Mitchell was accused of stealing; (2) denying his motion for a judgment of acquittal when the evidence showed the value of the metal was either $22,000 or less than $1,000; and (3) failing to give Mitchell's requested jury instructions on the law of mistake of fact and good faith.

The circuit court affirmed an ejectment order issued by the magistrate's court against Appellant Mary T. Hobby. Ms. Hobby appeals the circuit court's ruling, arguing the circuit court erred in failing to find (1) the magistrate lacked subject matter jurisdiction to adjudicate the matter, (2) the matter was barred by res judicata, and (3) the magistrate made findings inconsistent with a prior order issued by the circuit court in an action involving the same parties and subject property, thus in essence inappropriately reversing the prior order of the circuit court.

On appeal from the family court, Rubin Simmons (Husband) argues the family court erred by (1) inequitably ordering him to pay Essie Simmons (Wife) retroactive equitable distribution and alimony arrearages, as well as monthly permanent periodic alimony and equitable distributions payments; (2) awarding Wife attorney's fees that are unsupported by the evidence; and (3) vacating his motion to compel a DNA test of his adult son.

Appellant Robert Jones claims the circuit court erred in granting Respondents Builders Investment Group, LLC and Brian D. Boone's (collectively, Respondents) motion for judgment notwithstanding the verdict. The Court of Appeals addresses Jones's claims that the circuit court erroneously (1) held Jones's personal payment of the parties' business loan discharged Respondents from their legal responsibility to contribute towards the payoff of the business loan; and (2) construed the terms of the parties' operating agreement regarding personal guaranties.
