Chief Appellate Defender Robert Michael Dudek of Columbia SC for Respondent Bowen Gray Turner. Attorney General Alan McCrory Wilson and Senior Assistant Attorney General Mark Reynolds Farthing, both of Columbia; and John William Weeks, of Aiken, all for Respondent The State.

Bowen G. Turner pled guilty to first degree assault and battery of Victim C.B. (Victim). Victim appeals the plea court's denial of her motion to enforce victims' rights, her rule to show cause against Elloree Bail Bonding Company, and her petition for a writ of mandamus.

 10:40 a.m. (Time Limits: 10-10-5)
2022-000392    Wolfe Marie Vernon Trust, Appellant, v. The Town of Mount Pleasant and The Mount Pleasant Board of Zoning Appeals, Respondents.

Thomas J. Rode, of Charleston, for Appellant. Stephen Lynwood Brown, Russell Grainger Hines, and Brian Lee Quisenberry, all of Clement Rivers, LLP, of Charleston, for Respondents.

In this civil matter, the Wolfe Marie Vernon Trust (Owner) appeals the circuit court's order denying her appeal from the decision of the Mount Pleasant Board of Zoning Appeals (the Board). Owner argues the Board (1) misinterpreted and misapplied the "building line" definition found in the Mount Pleasant Zoning Code (the Code) and (2) violated the stated purpose of the Special R 2 Overlay Zoning District (the SOD) ordinance by denying her permit request to make additions to her house.

Courtroom I
 10:00 a.m. (Time Limits: 10-10-5)
2022-001165    Michael D. Royal, Appellant, v. Free Kindergarten Association of Charleston, Respondent, The Attorney General of the State of South Carolina and The Charleston County School District, Respondents.

Evan Patrick Williams and Jeffrey Scott Tibbals, Sr., both of Bybee & Tibbals, LLC, of Mount Pleasant, for Appellant. Warren W. Ariail and A. Bright Ariail, both of Law Office of A. Bright Ariail, LLC, of Charleston, for Respondent Charleston County School District. Joseph Kevin Qualey, of Qualey Law Firm, of Charleston; and Patrick F. Stringer, of Stringer & Stringer, of Charleston, both for Respondent Free Kindergarten Association of Charleston. Assistant Attorney General Mary Frances G. Jowers, of Columbia; and Kristin M. Simons, of Columbia, both for Respondent The Attorney General of the State of South Carolina.

Michael D. Royal appeals the order of the master in equity granting the Attorney General's (AG's) motion for nonsuit in this action for breach of contract and specific performance of a real estate purchase agreement (the Agreement) between Royal and Free Kindergarten Association of Charleston (FKAC). Royal argues the master erred by (1) finding FKAC was governed by the 1994 Nonprofit Corporation Act; (2) finding June Murray Wells did not have authority to execute the Agreement on behalf of FKAC; (3) finding the Agreement violated public policy; (4) refusing to grant specific performance of the Agreement and granting the AG's motion for nonsuit; (5) finding the AG had "veto power" over the Agreement and allowing the AG to intervene in the action; (6) allowing the Charleston County School District (CCSD) to intervene and file affirmative claims in the action; and (7) excluding the transcript of CCSD's Rule 30(b)(6) deposition.

 10:40 a.m. (Time Limits: 10-10-5)
2021-000944    Blythewood Oil Co., Inc., Appellant, v. Shinda Singh, Five Rivers, Inc., and Singh, Inc., Respondents.

Tony R. Megna, of Blythewood, for Appellant. Linda Zeigler Jackson, of Jackson & Jackson, of Columbia, for Respondents.

Blythewood Oil appeals the circuit court's order finding it was not entitled to recovery against Shinda Singh, Five Rivers, Inc., and Singh Inc., for nonpayment following Blythewood Oil's delivery of gasoline to two convenience stores. Blythewood Oil argues the circuit court erred in failing to direct a verdict on its claim for unjust enrichment because (1) Shinda admitted he formed a partnership to own and operate the convenience stores, (2) Shinda failed to notify Blythewood Oil of any change in store ownership, and (3) the law of estoppel and agency bars Respondents' asserted defenses.

 11:20 a.m. (Time Limits: 10-10-5)

Courtroom I
 10:00 a.m. (Time Limits: 10-10-5)
2022-001226    Jane E. Baskin, Respondent, v. William B. Walkup, Appellant.

Sarah P. Spruill, of Haynsworth Sinkler Boyd, PA, of Greenville; and Thornwell F. Sowell, III and Bess Jones DuRant, both of Sowell & DuRant, LLC, of Columbia, all for Appellant. Richard C. Detwiler and Harry Alwyn Dixon, both of Callison Tighe & Robinson, LLC, of Columbia, for Respondent.

William B. Walkup appeals two probate court orders, arguing the court erred in (1) removing him as trustee of a trust benefitting Jane E. Baskin; (2) failing to recuse itself; (3) finding him in contempt; and (4) failing to award him attorneys' fees and awarding attorneys' fees to Baskin.

 10:40 a.m. (Time Limits: 10-10-5)
2023-000581    James Ware, Alisa Ware, Henry Spahr, Elaine Spahr, Julie Sanders, William Craig Denny, Jeff Toomer, Allyson Toomer, Louis E. Davis, Donna Nutty, Thomas J. MacDonald, Michael G. MacDonald, Susanne B. MacDonald, Arlene Coleman, William H. McGee, Patti M. MacDonald, Scott M. MacDonald, Rose F. McGee, Jason DuBose, Amanda DuBose, Ronald L. Broome, Lawrence E. Jones, D. Diane Burr, Mark H. Thomas, Kelly C. Thomas, William Matthew Yollo, Nancy H. Yollo, Joseph DeAngelis, Beth DeAngelis, Shelly Horn, Theodore Brammer, Allison Brammer, Waymon W. Durden, Constance C. Durden, and David C. Powell, Respondents, v. Beaufort County, HPCCA Ferry Company, Inc., and The Daufuskie Island Ferry Service, LLC, Defendants, of which Beaufort County is the Appellant.

Danny Calvert Crowe, of Crowe LaFave Garfield & Bagley, LLC, of Columbia, for Appellant. Thomas C Taylor, of Law Offices of Thomas C. Taylor, LLC, of Bluffton, for Respondents.

Beaufort County (the County) appeals the circuit court's grant of the Respondents' request for a preliminary injunction prohibiting the County from operating commercial ferry boats from the Buckingham Landing site as of January 1, 2024. The County argues the circuit court erred by (1) issuing an overly broad preliminary injunction, (2) failing to consider a parallel administrative proceeding that determined the County's use of the commercial dock for a public ferry was a "legal use" under the zoning ordinance, (3) issuing a preliminary injunction when Respondents failed to provide evidence of irreparable harm, (4) failing to consider adequate remedies at law available to Respondents, and (5) setting a low injunction bond of $10,000.

 11:20 a.m. (Time Limits: 10-10-5; 10-10-5)
2022-000328    Mark Shaffer, as Personal Representative of the Estate of Susan Shaffer, Appellant, v. DEH Disaster Recovery, LLC; Ceres Environmental Services, Inc.; Beaufort County, A Political Subdivision of the State of South Carolina; Ryan Colter Stoltz; Matt T. Dotson; Tim Tod Dotson; Brandi Dotson; Spencer A. Olson Trucking, LLC; Byers Products, Co.; And TruckPro, LLC, Defendants, of which Ceres Environmental Services, Inc. and Beaufort County, A Political Subdivision of the State of South Carolina are the Appellants-Respondents, and Spencer A. Olson Trucking, LLC, DEH Disaster Recovery, LLC, and Ryan Colter Stoltz are the Respondents.

H. Fred Kuhn, Jr., of Kuhn Law Firm LLC, of Beaufort, SC for Appellant. R. Patrick Flynn, of Flynn Law Firm, LLC, of Charleston, for Appellants-Respondents. Shawn M. Bevans, of McAngus Goudelock & Courie, LLC, of Columbia, for Respondents Ryan Colter Stoltz and DEH Disaster Recovery, LLC. Kelly Dennis Dean and Ernest Mitchell Griffith, both of Griffith Freeman & Liipfert, LLC, of Beaufort; and Julius W. Gernes and Steven D. Pattee, both of Minneapolis, MN, all for Respondent Spencer A. Olson Trucking, LLC.

These two appeals result from a fatal motor vehicle accident. The wreck involved a personal vehicle and a commercial vehicle cleaning up storm debris after a hurricane. The deceased motorist's estate appeals a summary judgment order finding there was no viable negligence claim against Beaufort County or the principal contractor hired to manage the cleanup operation. Beaufort County and the principal contractor appeal two summary judgment orders finding they did not have viable indemnity claims against others involved in the cleanup operation.

Courtroom I
 10:00 a.m. (Time Limits: 10-10-5)
2022-000300    Historic Beaufort Foundation, Appellant, v. City of Beaufort, City of Beaufort Historic District Review Board, and The Beaufort Inn, LLC, Respondents. AND West Street Farms, LLC and Mix Farms, LLC, Appellants, v. City of Beaufort, City of Beaufort Historic District Review Board, and The Beaufort Inn, LLC, Respondents.

W. Andrew Gowder, Jr., of Austen & Gowder LLC, of Charleston, for Appellants West Street Farms, LLC and Mix Farms, LLC. John A. Massalon and Carissa Jean Steichen, both of Wills Massalon & Allen LLC, of Charleston, for Appellant Historic Beaufort Foundation. Benjamin Edward Nicholson, V, and Glenn Wade Leach, III, both of Burr & Forman LLP, of Columbia, for Respondent The Beaufort Inn, LLC. Alexis Kaylor Lindsay and Virginia Patterson Bozeman, both of Pope Flynn, LLC, of Columbia, for Respondents City of Beaufort and City of Beaufort Historic District Review Board.

In these consolidated appeals, Appellants, the Historic Beaufort Foundation, Inc., West Street Farms, LLC, and Mix Farms, LLC, seek review of the circuit court's orders upholding the decisions of the City of Beaufort Historic District Review Board (the Board) issuing Certificates of Appropriateness to Respondent Beaufort Inn, LLC (Beaufort Inn) for the development of a hotel and a parking garage. Appellants argue the Board erred in granting final approval to both projects because the preliminary approval for them had expired. Appellants also argue that the local zoning ordinances required Beaufort Inn to obtain a special exception for large footprint buildings and this was a condition precedent to the Board's approval of both projects.

 10:40 a.m. (Time Limits: 10-10-5)
2023-000953    West Street Farms, LLC and Mix Farms, LLC, Appellants, v. City of Beaufort, Beaufort Inn, LLC, and 303 Associates, LLC, Respondents.

W. Andrew Gowder, Jr., of Austen & Gowder LLC, of Charleston, for Appellants. Benjamin Edward Nicholson, V, of Burr & Forman LLP, of Columbia, for Respondents Beaufort Inn, LLC and 303 Associates, LLC. Lawrence Emile Flynn, III and Alexis Kaylor Lindsay, both of Pope Flynn, LLC, of Columbia; and Virginia Patterson Bozeman, of Pope Flynn, LLC, of Columbia, all for Respondent City of Beaufort.

In this declaratory judgment action, Appellants, West Street Farms, LLC, and Mix Farms, LLC, seek review of the circuit court's order denying their request for a judgment declaring that certain decisions of the City of Beaufort Historic District Review Board (the Board) were void. Appellants argue the circuit court erred in concluding that the issues were identical to the issues in the consolidated appeals for Historic Beaufort Foundation v. City of Beaufort, et al. and West Street Farms, LLC, et al. v. City of Beaufort, et al. Appellants also argue that the circuit court erred in concluding that they had not exhausted their administrative remedies because the court should have analyzed the case under the doctrine of collateral estoppel.

 11:20 a.m. (Time Limits: 10-10-5)
2021-000989    The State, Respondent, v. Bradley Mark Corlew, Appellant.

Sarah Elizabeth Shipe, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Senior Assistant Attorney General Mark Reynolds Farthing, both of Columbia; and Solicitor Randy E. Newman, Jr., of Lancaster, all for Respondent.

Bradley M. Corlew appeals his convictions of criminal sexual conduct with a minor in the first degree, criminal sexual conduct with a minor in the second degree, and incest, for which he was sentenced to life imprisonment, twenty years' imprisonment, and ten years' imprisonment, respectively. Corlew assigns error to the circuit court's (1) allowing the State to introduce "bad acts" evidence pursuant to Rule 404(b), SCRE, and as part of the res gestae of the crimes alleged; (2) admitting into evidence an adolescent questionnaire wherein one of the victims identified Corlew as her abuser; (3) allowing an expert witness to describe sexually explicit photographs found on Corlew's phone; and (4) requiring Corlew to move his position in the courtroom in a manner that allegedly violated Corlew's constitutional right to confrontation.

 12:00 p.m. (Time Limits: 10-10-5)
2022-000731    In the Matter of: Estate of Florence Petrak Mensch Sterling Raymond Mensch, III, individually, as former Personal Representative of the Estate of Florence Petrak Mensch and in the former capacity as Agent under a Power of Attorney for Florence Petrak Mensch, Appellant, v. Shauna M. Waddell, individually and as Personal Representative of the Estate of Florence Petrak Mensch and John R. Mensch, Respondent.

Devon Marc Puriefoy, of Truluck Thomason, LLC, of Greenville, for Appellant. Knox L. Haynsworth, III and Tyler Earl McLeod, both of Brown Massey Evans McLeod & Haynsworth, LLC, of Greenville, for Respondent.

In this matter regarding the estate of Florence Petrak Mensch, damages were awarded to Respondent as Personal Representative by the probate court for Appellant's breach of fiduciary duty, violation of the Uniform Power of Attorney Act, and conversion in his management of Mensch's estate. After the probate court's denial of Appellant's motion to alter and amend under Rule 59, SCRCP, Appellant appealed to the circuit court. Following the dismissal of the case by the circuit court, Appellant appealed to this court and alleged the probate court lacked jurisdiction to award damages for conduct prior to Mensch's death, the circuit court lacked jurisdiction without a final order from the probate court, and were there a final appealable order, the circuit court erred in finding the appeal untimely.

Shafi, Lather Construction, Inc., Hutton's Landscapes, Inc., and East Coast Construction Cleanup Corp. f/k/a S.C Cleanup Co., Inc. are the Respondents, And D.R. Horton, Inc. is the Appellant.

Carl F. Muller, of Carl F. Muller, Attorney at Law, P.A., of Greenville, for Appellant. Megan Christine White, of Mount Pleasant; Carmen Vaughn Ganjehsani, of Richardson Plowden & Robinson, PA, of Columbia; and Emily Gifford Lucey, of Richardson Plowden & Robinson, PA, of Mt. Shafi and Sarmed Shafi.

D.R. Horton, Inc. appeals the circuit court's dismissal of its cross-claims for contractual indemnification against Lather Construction, Inc., Hutton's Landscapes, Inc., and East Coast Construction Cleanup Corp. (collectively, Respondents). D.R. Horton argues that the circuit court erred in dismissing its cross-claims because the circuit court (1) did not have subject matter jurisdiction and authority to overrule the denial of Respondents' prior motions for summary judgment, (2) exceeded its authority in attempting to force a settlement, (3) read a prohibition on a duty to defend into S.C. Code Ann. ยง 32-2-10 (2007), (4) overrode the parties' contractual agreements in ruling Respondents' respective duties to indemnify and defend were not separate and distinct obligations, and (5) ruled the provisions concerning indemnity and duty to defend in the parties' contractual agreements were unenforceable as a matter of law.

 12:00 p.m. (Time Limits: 10-10-5-5)
2022-001777    Christopher Young and Biotech Restorations, LLC, Appellants/Respondents, v. Joanna Marie Paynter, a/k/a Joey Painter, Samantha P. Nelson, and Paynter Consulting, LLC, Respondents/Appellants.

Wesley D. Few, of Wesley D. Few LLC, of Greenville, for Appellants-Respondents. Steven R. LeBlanc, of Steve LeBlanc, LLC, of Greenville, for Respondents-Appellants.

This appeal and cross-appeal arise from the circuit court's order interpreting a General Partnership Agreement (GPA) executed by Appellant-Respondent Christopher Young and Dr. Valerie Paynter. Appellants-Respondents Christopher Young and Biotech Restorations, LLC, argue the circuit court erred by: (1) finding the Respondents-Appellants (Daughters) were the owners of Factor Technology; (2) construing the partnership provisions "in the event of a death of a partner;" (3) construing the partnership to provide Daughters exclusive use and control of Factor Technology; and (4) failing to find a partnership breach and intentional interference by Daughters. Daughters cross-appeal the circuit court's denial of their motion for a directed verdict.
