In this appeal from convictions for armed robbery, possession of a weapon during the commission of a violent crime, conspiracy, and resisting arrest, Brian Lewis asserts the trial court erred in (1) including "searching for the truth" language in its reasonable doubt charge, (2) declining to charge his requested jury instructions on identification and credibility, and (3) admitting his out-of-court statements because they were not knowingly, intelligently and voluntarily made.

Courtroom I
 10:00 a.m. (Time Limits: 10-10-5-5)
2016-002556    Russell Shane Carter, Respondent/Appellant, v. Bruce Bryant, as Representative for the Office of the York County Sheriff, Appellant/Respondent.

Andrew F. Lindemann of Lindemann, Davis & Hughes, PA, of Columbia, for Appellant/Respondent. Robert David Garfield of Crowe LaFave, LLC, of Columbia, for Appellant/Respondent. Alexandre Thomas Postic of Law Offices of Alex Postic, of Columbia, for Respondent/Appellant. John Christopher Mills of J. Christopher Mills, LLC, of Columbia, for Respondent/Appellant.

This cross-appeal arises from malicious prosecution and false arrest claims brought by Russell Shane Carter against Bruce Bryant as the representative of the York County Sheriff's Office (Bryant). On appeal, Bryant argues the trial court (1) erred in denying him sovereign immunity pursuant to section 15-78-60(23) of the South Carolina Code (2005) on Carter's claim for malicious prosecution; (2) erred in denying his motions for a directed verdict and a judgment notwithstanding the verdict (JNOV) on Carter's claim for malicious prosecution because Carter did not provide evidence that no probable cause existed to issue a warrant for his arrest; (3) erred in refusing to charge the jury with an instruction he requested on the degree of proof required to establish probable cause; and (4) abused its discretion in allowing Carter to claim $17,500 in criminal attorney's fees as damages when he only disclosed $5,000 of criminal attorney's fees during discovery. Carter argues the trial court erred in (1) excluding his expert witness's testimony because it lacked foundation, and (2) directing a verdict on his cause of action for false arrest because the arrest was based on a facially valid warrant.

Appellate Defender Susan Barber Hackett, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Assistant Attorney General Jonathan Scott Matthews, both of Columbia, for Respondent. Solicitor Scarlett Anne Wilson, of Charleston, for Respondent.

Mack Seal Washington appeals his convictions of first-degree burglary, malicious injury to property, and obtaining goods by false pretenses, arguing the trial court erred in not suppressing certain statements made by law enforcement during an interrogation because they constituted improper opinion evidence and improperly shifted the burden of proof from the State to him.

 11:20 a.m. (Time Limits: 10-10-5)
2017-001817    Daniel Eric Knight, Respondent, v. Phillip Ray Causey, Appellant.

Joseph DuRant Thompson, III, of Hall Booth Smith, PC of Mount Pleasant, for Appellant. Ian D. Maguire and P. Brooke Eaves Wright, both of Maguire Law Firm, of Myrtle Beach, for Respondent., Blake A. Hewitt of Bluestein Thompson Sullivan LLC, of Columbia, for Respondent.

Philip Causey appeals the special referee's default judgment award of $3,489,206.14 in actual damages to Daniel Knight, arguing (1) the special referee erred in denying Causey's motions for a new trial because the judgment was grossly excessive, shocked the conscience, and was unsupported by admissible evidence; (2) the special referee erred in denying Causey's motion to alter or amend the judgment because the special referee awarded future damages for a surgery that had occurred by the time the judgment was entered; (3) Causey did not receive proper notice of the default damages hearing; (4) the special referee lacked jurisdiction to decide Causey's motion to set aside default and demand for a jury trial; (5) the special referee erred in failing to grant Causey's motion to set aside default and demand for a jury trial; (6) the special referee lacked the jurisdiction to hold a damages hearing because the referral of the case to the special referee was procedurally defective; (7) the special referee erred in denying Causey's motion for a new trial for failure of due process and bias of the special referee; and (8) the special referee erred in denying Causey's motion for relief from judgment pursuant to Rule 60(b), SCRCP.

Chisolm Frampton (Claimant) appeals the order of the South Carolina workers' compensation commission's appellate panel reversing the single commissioner's order, arguing (1) the appellate panel erred in requiring Claimant to prove a compensable injury to his spine after liability had been admitted; and (2) the single commissioner erroneously used Claimant's post-injury return to work and subsequent promotions in determining his impairment rating.
