The State appeals the granting of post-conviction relief to James Helms, arguing the post-conviction relief court erred in finding Helms received ineffective assistance of counsel when he pled guilty to a non-parole-eligible offense in reliance on information provided by his counsel that he would be eligible for parole after approximately eighteen months.

In this post-conviction relief (PCR) action, Vondell Sanders contends the PCR court erred in finding trial counsel effective despite failing to move for a mistrial when the trial transcript only reflects responses from eleven jurors during polling. Sanders also argues that even if the missing juror was present during polling, her PCR hearing testimony shows the verdicts were not unanimous because she says she voted "not guilty."

George White appeals his convictions for lewd act on a minor and second-degree criminal sexual conduct with a minor. White argues (1) the trial court erred in admitting into evidence a videotaped forensic interview of the minor, (2) South Carolina Code section 17-23-175 is unconstitutional as applied in this case, (3) the trial court erred in allowing the State to elicit a forensic interviewer's opinion about the minor's credibility, (4) the forensic interviewer's testimony was offered as improper character evidence, and (5) the trial court erred in denying White's motion for a directed verdict because the State failed to introduce evidence of all the elements of second-degree criminal sexual conduct with a minor.

Scarborough contends the trial court (1) erred in not severing the seven original indictments against Scarborough, (2) erred in allowing a witness to testify regarding prior alleged abuse by Scarborough, (3) abused its discretion in not declaring a mistrial after one minor denied he was abused by Scarborough, and (4) erred in not directing a verdict on the three charges of dissemination of obscene material.

Appellants, several inmates participating in a prison industries service project operated by Respondent South Carolina Department of Corrections, seek review of an order of the South Carolina Administrative Law Court upholding the Department's dismissal of Appellants' Step 1 grievances. Appellants argue that their grievances challenging the rate at which the Department paid them for their labor was not subject to the fifteen-day filing deadline because these grievances concerned a policy or procedure rather than an "incident." Appellants also argue that even if the fifteen-day deadline applied to their grievances, the fifteen-day period did not begin to run until after the South Carolina Supreme Court issued the remittiturs for Adkins v. South Carolina Department of Corrections, 360 S.C. 413, 602 S.E.2d 51 (2004) and Wicker v. South Carolina Department of Corrections, 360 S.C. 421, 422, 602 S.E.2d 56, 56 (2004).

Appellant Moore Taylor & Thomas, P.A. sued Marsha Banks and Respondent Mary Guynn, alleging that both Banks and Guynn breached duties owed to Appellant. Appellant claimed that Guynn, the closing attorney in a real estate transaction in which Appellant's former client was the seller, breached a duty to Appellant by refusing to recognize its interest in the sales proceeds. The trial court granted Guynn's motion to dismiss the claims against her, ruling Moore Taylor & Thomas could not recover against Guynn because (1) there was no attorney-client relationship between them and (2) Moore Taylor & Thomas alleged only an oral interest in the sales proceeds.

D&C Builders contends the trial court erred (1) in ordering it to reveal confidential information to substantiate the disqualification of opposing counsel, (2) in refusing to grant an injunction preventing opposing counsel from accessing the confidential information D&C Builders was ordered to supply, and (3) in failing to disqualify opposing counsel.
