In an appeal from an adverse jury award, Ford Motor Company contends the trial court allowed unqualified experts to testify about an unrelated vehicle recall and prohibited them from impeaching the experts with the true reason for the recall. Second, Ford argues the trial court improperly allowed the jury to consider the plaintiff’s claim for emotional distress where they failed to introduce expert testimony as required by law. Finally, Ford contends the award of punitive damages was unsupported by the evidence, excessive, and in violation of their right to due process.

The State brought this action under the Sexually Violent Predator Act, S.C. Code Ann. § 44-48-10 to -170 (Supp. 2007) for a determination that Appellant was a sexually violent predator in need of involuntary civil commitment in a secure facility for long-term control, care, and treatment. A jury found that Appellant was a sexually violent predator, and the trial court ordered that Appellant be committed to the South Carolina Department of Mental Health. Appellant challenges the commitment order on the ground that the trial court failed to charge the jury that Appellant had a Fifth Amendment right to remain silent and that the jury could not draw an adverse inference from his failure to testify at the commitment proceeding.

This appeal arises from the grant of a motion to dismiss for lack of subject matter jurisdiction pursuant to Rule 12(b)(1), SCRCP. The Appellant, TCI Media, Inc. (TCI) contracted with Respondent NuVox Communications, Inc. (NuVox) to provide certain services to TCI, including the electronic storage of certain information. Among other obligations, NuVox was required to provide certain Customer Proprietary Network Information (CPNI) to TCI regarding its account, upon TCI’s request. TCI requested CPNI, along with other information, to assist it in an ongoing federal criminal case in which TCI was a defendant. NuVox refused to provide any information to TCI. Subsequently, TCI filed a complaint against NuVox alleging that NuVox breached the contract and breached its fiduciary duty to TCI by refusing to provide the information TCI requested. In response, NuVox filed a motion to dismiss, or in the alternative, to stay litigation, and the circuit court granted the motion, finding that TCI brought the lawsuit solely to circumvent the discovery provisions of the Federal Rules of Criminal Procedure.
