Appellant contends she was deprived of due process because the guardian ad litem's report failed to comply with section 20-3-830(A)(6) of the South Carolina Code (2008). Richard Avon Green appeals his conviction of the common law charge of attempted burglary. He contends that because attempted burglary is not a lesser included offense of first degree burglary, the trial court erred in submitting the claim of attempted first degree burglary to the jury after it granted a directed verdict in his favor on the charge of first degree burglary.

 10:40 a.m. (Time Limits: 10-10-5)
2010-167027    Ayree Henderson, Respondent, v. State of South Carolina, Petitioner.

This is a post-conviction relief (PCR) matter wherein the PCR judge granted Henderson's application for relief. The issues raised are (1) whether the PCR court correctly determined Henderson's prior conviction for accessory after the fact to murder was not a crime of dishonesty or false statement under Rule 609(a)(2), SCRE, and (2) if such crime is not a crime of dishonesty or false statement, whether the PCR court correctly concluded Henderson was prejudiced by the admission of the evidence under Rule 609(a)(1), SCRE.

 10:40 a.m. (Time Limits: 10-10-5)
2012-213155    Rivers Point Row Horizontal Property Regime a/k/a Rivers Point Row Property Owners Association, Inc., Respondent, v. Palms Properties, LLC, Defendant.  11:20 a.m. (Time Limits: 10-10-5)
2008-092411    Israel Wilds, Respondent/Petitioner, v. State of South Carolina, Petitioner/Respondent.

Tara Dawn Shurling of Law Ofice Of Tara Dawn Shurling, PA, of Columbia, for Respondent/Petitioner. Senior Assistant Deputy Attorney General Salley W. Elliott, Assistant Attorney General Jennifer Ellis Roberts, and Assistant Deputy Attorney General David A. Spencer, all of Columbia, for Petitioner/Respondent.

In this cross-appeal involving an action for post-conviction relief (PCR), the State argues the PCR court erred in finding Israel Wilds' appellate counsel was ineffective for failing to raise the issues of accomplice liability and mere presence on appeal. In his cross-appeal, Wilds argues the PCR court erred in finding his trial counsel was not ineffective for failing to assert at trial that the trial court's ruling that he could not cross-examine his co-defendants about the potential sentences they faced violated his Confrontation Clause rights.

 12:00 p.m. (Time Limits: 10-10-5)
2012-213333    The St. Clements Homeowners Association, Inc., Appellant, v. BE-MI, Inc., Respondent.

Appellant, St. Clements Homeowners Association, Inc. appeals the Master-in-Equity's order, in which the Master denied appellant's claim for an injunction and ordered that respondent BE-MI, Inc. had the right to retain and maintain a certain side deck. Appellant contends the Master erred in finding the respondent was entitled to retain and maintain the side deck, appellant's claim for an injunction should be denied, appellant was not entitled to recover attorney's fees and costs, and appellant's claim was barred by equitable estoppel, res judicata, and a balancing of the equities.

Wednesday, November 6, 2013
Courtroom II
 10:00 a.m. (Time Limits: 10-10-5)
2011-202547    The State, Respondent, v. Eric Wright, Appellant.

Appellate Defender David Alexander, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Assistant Attorney General William M. Blitch, Jr., both of Columbia, for Respondent.

Eric Wright appeals his convictions of assault and battery with intent to kill and possession of a weapon during the commission of a violent crime. Wright asserts three grounds of error by the trial court: (1) refusing to grant his motion for mistrial based upon the State deliberately eliciting hearsay testimony the trial court had previously ruled inadmissible; (2) denying his Batson motion because the State's gender-neutral reason for striking male jurors was pretext; and (3) removing the foreperson as a juror without good cause and over his and the foreperson's objection.

 10:40 a.m. (Time Limits: 10-10-5)
2012-212373    Jane RM Doe, Respondent, v. Omar Jaraki, Halla Jaraki, Cardiology & Arrhythmia Consultants, Cardiology and Arrhythmias Consultant, Institute of Electrophysiology, P.C., Defendants, Of whom Omar Jaraki and Halla Jaraki are the Appellants.

In this sexual battery case, Omar and Halla Jaraki challenge an entry of default against them, asserting their response sufficiently answered Jane Doe's complaint. In addition, the Jarakis contend the trial court erred in denying their motion for relief from default judgment.

 11:20 a.m. (Time Limits: 10-10-5)
2012-212812    Jane AP Doe, Respondent, v. Omar Jaraki, M.D., Halla Jaraki, Cardiology & Arrhythmia Consultants, Cardiology & Arrhythmias Consultant, Institute of Electrophysiology, P.C., Defendants, Of whom Omar Jaraki and Halla Jaraki are the Appellants.

William Isaac Diggs of Law Office of William Isaac Diggs, of Myrtle Beach, for Appellants. O. Fayrell Furr, Jr. of Furr & Henshaw, of Myrtle Beach, for Respondent. John S. Nichols of Bluestein Nichols Thompson & Delgado, LLC, of Columbia, for Respondent.

In this sexual battery case, Appellants, Omar Jaraki and Halla Jaraki, seek review of the trial court's order denying their motion for relief from an entry of default against them. Appellants argue that the letters they sent to counsel for Respondent Jane "AP" Doe, which sought additional information about Respondent's identity, were legally sufficient to constitute a responsive pleading for purposes of avoiding an entry of default. Appellants also argue that their failure to follow the mediation process set forth in section 15-79-125 of the South Carolina Code may not constitute a basis for the trial court to prohibit the filing of responsive pleadings.
