State of South Carolina, Petitioner, v. Rorey Jamar Johnson, Respondent
Respondent was convicted in circuit court in Greenville County of murder. However, the trial judge granted respondent a new trial based on a statement by a witness that she had not passed a polygraph (lie detector) test. The State of South Carolina appealed, arguing the trial judge abused his discretion in granting a new trial based on the brief comment by the witness. The Court of Appeals affirmed the trial judge’s decision. The State now asks the South Carolina Supreme Court to review the Court of Appeals’ decision.
