RE: Municipal Judge Territorial Jurisdiction
O R D E R
I FIND THAT municipal judges are often required to conduct bond proceedings and perform other judicial functions at county detention facilities which are located outside of the territorial boundaries of their municipalities.
THEREFORE, pursuant to Article V, Section 4, South Carolina Constitution,
IT IS ORDERED that municipal judges are vested with jurisdiction at county detention facilities located outside of the territorial boundaries of their municipalities to conduct bond proceedings, issue warrants, and, when necessary for security purposes, conduct preliminary hearings. The authority granted to municipal judges pursuant to this Order is limited to the judicial functions enumerated herein.
This Order is effective immediately and remains in effect unless amended or revoked by further Order of the Chief Justice.
