ORDER


The memoranda filed by the parties in this matter subsequent to this Court granting the petition for original jurisdiction indicate the parties are in agreement on the merits of the issue before the Court.  As a result, we have determined oral argument scheduled for January 18, 2017, is no longer necessary and is hereby cancelled.  An opinion in the matter shall be forthcoming.
