Chief Judges for Administrative Purposes of the Summary Courts

The Supreme Court has amended Rule 426, SCACR, which concerns the Provision of Legal Services Following Determination of Major Disaster, to include comments to the rule.


At the request of the South Carolina Bar, the Supreme Court has adopted amendments to Rules 1.0, 1.1, and 1.6 of the Rules of Professional Conduct, which are found in Rule 407 of the South Carolina Appellate Court Rules.


– Supreme Court of South Carolina Chief Justice Donald W. Beatty authorized six judges to preside over Adoption Day proceedings, which took place Monday, Nov. 25. During these special terms of court, approximately 69 children were adopted into 50 families.


The Supreme Court is accepting written comments concerning a proposed amendment to the South Carolina Rules of Civil Procedure.


At the request of the Commission on Lawyer Conduct and the Commission on Judicial Conduct, the Court has amended the Rules for Lawyer Disciplinary Enforcement, which are found in Rule 413, SCACR; the Rules for Judicial Disciplinary Enforcement, which are found in Rule 502, SCACR; the Rules of Professional Conduct, which are found in Rule 407, SCACR; Rule 428, SCACR; and Rule 3, CJC, Rule 501, SCACR.


At the request of the South Carolina Bar, the Supreme Court has amended the Code of Judicial Conduct to include language permitting judges to encourage lawyers to provide pro bono services.


At the request of the South Carolina Bar, the Supreme Court has amended Rule 411(b), SCACR, to permit members of the Lawyers' Fund for Client Protection Committee to serve up to two consecutive terms, and to allow the Court to appoint members for less than a full three-year term to stagger membership terms.

I FIND that the South Carolina Access to Justice Commission has petitioned the Supreme Court of South Carolina to create a homeless court in the City of Spartanburg Municipal Court (hereinafter “Spartanburg Homeless Court Program”) to handle minor offenses pertaining to qualified homeless participants.

Based on the impact of Hurricane Dorian and the resulting closure of county offices in Charleston County, the prior Order directing that E-Filing commence in Charleston County on September 18, 2019, is rescinded. An Order will be issued setting a new date for the commencement of E-Filing in Charleston once that decision has been made.


On August 31, 2019, the Governor of South Carolina issued an executive order declaring a state of emergency existed throughout the State of South Carolina in anticipation of the arrival of Hurricane Dorian.


Inclement Weather

South Carolina Governor Henry McMaster has declared a “state of emergency,” and the National Hurricane Center is forecasting that South Carolina will experience severe weather starting Wednesday as a result of Hurricane Dorian. Gov. McMaster has issued a mandatory evacuation for coastal areas and has announced the closure of state government offices in a number of coastal counties beginning Tuesday.

On August 1, the Court approved amendments to the Rules of the Board of Law Examiners found at Appendix A to Part IV of the South Carolina Appellate Court Rules. The Rules relate to Special Accommodations for Disabled Applicants. Generally, the changes require all medical records to be filed with an applicant's original request and limits the record on appeal to the documents considered by the Board in making its decision.

The judges of the magisterial and municipal courts, hereinafter referred to as "summary courts," of South Carolina being a part of the uniform statewide judicial system and pursuant to the provisions of Article V, Section 4 of the South Carolina Constitution.


The South Carolina Judicial Branch will conduct emergency network maintenance on June 20, 2019, beginning at approximately 9:00 PM affecting many of our systems, including E-Filing. It is expected that maintenance will be completed no later than 10:00 PM. E-Filers will not be able to access the E-Filing application or E-File documents during the maintenance window.


The South Carolina Court of Appeals held a special session on Thursday, June 6, at the Francis Marion Performing Arts Center.


The Supreme Court has amended Rule 1.6 of the Rules of Professional Conduct, contained in Rule 407 of the South Carolina Appellate Court Rules, to add a new comment to Rule 1.6. The Court has also amended Rules 1.0 and 1.10 of the Rules of Professional Conduct to correct minor scrivener's errors in those rules.


The Supreme Court has amended Rule 422 of the South Carolina Appellate Court Rules to alter the composition of the Commission on Alternative Dispute Resolution to provide for the appointment of three at-large members, who may be lawyers, judges, or public members.


The South Carolina Access to Justice Commission has selected Hannah C. Honeycutt to serve as its new Executive Director. Honeycutt will lead the Commission in its mission to address barriers to legal representation in South Carolina.


The South Carolina Access to Justice Commission has petitioned the Supreme Court of South Carolina to create a pilot program establishing a Housing Court in the County of Charleston Magistrate Court (hereinafter “Charleston Housing Court Pilot Project”) to create an eviction docket on specific days in three specific Magistrate Courts in Charleston County. There is significant need to provide access to legal representation to tenants in Charleston County facing eviction. Increased representation can ensure that the eviction is lawful, defenses are effectively asserted, and secure other relief that may help prevent homelessness.

Since ninety days have passed since submission without rejection by the General Assembly, the amendments contained in the above orders are effective immediately.


Pursuant to the provisions of Article V, Section 4 of the South Carolina Constitution, SCCA Form 253 titled "Subpoena in a Criminal Case" is amended effective May 1, 2019.

Results of the February 2019 Uniform Bar Examination


The Supreme Court has amended Rule 408, Rule 504, and the CLE Regulations located in Appendix C to Part IV of the South Carolina Appellate Court Rules at the request of the South Carolina Bar and the Commission on Continuing Legal Education and Specialization. Among other things, the amendments increase the substance abuse/mental health CLE requirements and permit lawyers to obtain more CLE hours through online programs.

Judicial Elections

Judicial elections were held February 6, 2019.


Pursuant to Article V, § 4A of the South Carolina Constitution, the following rule changes were submitted to the South Carolina General Assembly on January 31, 2019.


Accordingly, a federal employee who is a member of the South Carolina Bar under Rule 410 of the South Carolina Appellate Court Rules, and who is no longer being paid due to the shutdown, is hereby granted an extension to pay the 2019 license fees under Rule 410. The deadline for payment is extended to thirty (30) days after the federal government shutdown ends for that person's agency, department or other instrumentality of the United States.
